1. Terms of Use

By accessing the website, you agree to comply with these terms of service, all applicable laws and regulations and agree that you are responsible for compliance with all applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this website. The materials on this site are protected by applicable copyright and trademark laws.

Downtime surcharge: For each day of service unavailability, the customer will receive two bonus days (one day referring to the time the service remained unavailable and the other as a form of reward for the complication). Such bonus must be requested on the same day, otherwise it will be invalid.

Blocking / removal policy: Our suspension policy is 1 calendar days late, removal is 10 calendar days late, so avoid late payment and major problems; With the removal of the services, it will not be possible to recover files / content from FTP.

Closing of service provision: We reserve the right at any time to terminate, without prior notice, the service provision contract, due to suspected violation of the terms of services and usage policy, or due to commercial disinterest, performing the chargeback for the client of the remaining days of the service.

Price adjustments: Price readjustments can occur at any time due to several factors. New customers will pay the adjusted price and existing customers will be adjusted on the next due date; the readjustments will never come with prior warnings, but later so that the already customers are not negatively surprised.

About services and their purchase: The payment approval time varies according to the form of the payment, and goes immediately (credit card) to the variation of 1 to 2 working days (boleto), time reserved for bank clearing.

Disclaimer and Limitations: We do not guarantee that your use of our services will be uninterrupted, timely, safe or error-free. We do not guarantee that the results of using the services will be accurate or reliable, and may not achieve total customer satisfaction. You expressly agree that your use or inability to use the service is at your own risk. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability will be limited to the extent permitted by law.

Links: We do not analyze all the sites linked to your site and are not responsible for the content of any linked sites. The inclusion of any link does not imply endorsement by NikyusHosting of the site. The use of any linked website is at the user's own risk.

Modifications: NikyusHosting may revise these website terms of service at any time without notice. By using this website, you agree to be bound by the current version of these terms of service.

Applicable law: These terms and conditions are governed and interpreted in accordance with the laws of Brazil and you are irrevocably subject to the exclusive jurisdiction of the courts in that state or location.

2. Refund policy

The hosting offers a 48 hour full refund policy for game server hosting except business plans (over 16GB RAM) for which premium support will be offered. Any refund requests made outside of this 48 hour refund policy will be credited to the customer's account.
Services for which we do not offer refunds:
- We do not offer refunds for any add-on(s)
- We do not offer refunds for renewals under any circumstances.
- We do not offer refunds for updates
- Payments that were made to add funds to a customer's account.

You accept any refund requests made outside the first 48 hours of the service purchase date at our discretion. It is also at NikyusHosting's discretion whether a refund will be granted under any circumstances.
When canceling a service with us, it is your responsibility to cancel any paypal or stripe subscription you have linked to that service. Failure to do so will result in overpayments, which will be attributed to your credit balance.
It is also the customer's responsibility to cancel the service before the expiration date, if they do not wish to be billed or charged for it. Any refund request must be made through a ticket submitted through the client area of the "General Department" section, cancellation requests are not refund requests.

3. Cancellation Notice

NikyusHosting is not responsible if you accidentally create a cancellation request and your files are deleted.

4. Disputing / Chargeback

We ask all of our customers to kindly contact us before disputing a payment either through PayPal or your bank. This is because once a dispute has been created, the service will automatically be suspended and later terminated if the case isn't resolved. Any attempt(s) to de-fraud NikyusHosting will be taken very seriously and will be investigated.

5. Use of Third Parties

We are not responsible for any (MOD, FRAMEWORK, SCRIPT) or any third party tool that may harm or cause loss/damage to the user.

6. Server Setup Time

NikyusHosting does not guarantee instant setup, but we do try to provide as close as instant setup as possible. For shared hosting, you accept that in some rare instances it may take up to 24 hours, depending on the amount of traffic we're receiving, or if any issues occur in the automated setup process. Your billing will not start until your service has been set up.

7. Server performance and uptime

We aim to provide 100% uptime on all services, but that is not always the case. On the rare occasion, we may need to perform vital maintenance on your server, we will inform you 24 hours minimum before this maintenance takes place. If your server keeps crashing and is due to a third party application this can't be used as leverage to gain compensation.

8. Data loss

NikyusHosting will not be held responsible for backing up customers data unless the client has configured backups using our panel for their services.
